OROS Privacy Policy

BY USING THE WEBSITE, YOU EXPRESSLY CONSENT TO THE PROCESSING OF YOUR PERSONAL INFORMATION ACCORDING TO THIS PRIVACY POLICY. YOUR PERSONAL INFORMATION MAY BE PROCESSED IN THE COUNTRY WHERE IT WAS COLLECTED AS WELL AS OTHER COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING OF PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE LAWS IN YOUR COUNTRY.  BY UPLOADING PERSONAL INFORMATION TO THE WEBSITE YOU WARRANT THAT YOU HAVE THE RIGHT TO TRANSFER SUCH INFORMATION OUTSIDE YOUR COUNTRY AND INTO THE UNITED STATES.

SECTION 1 - WHAT INFORMATION DO WE COLLECT?

When you sign up for an email list, create an account or purchase something from our store you may voluntarily give us certain information about yourself, such as your name, address and email address.  We also collect records and copies of your correspondence (including email addresses) if you contact us.  If you’re using the Services on your mobile device, you may also choose to provide us with location data.

Purchase Information:  Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.   Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.  If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction and is then deleted.  All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.  PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.  For more insight, you may also want to read Shopify’s Terms of Service here or Privacy Statement here.

SECTION 2 – WHAT DO WE DO WITH YOUR INFORMATION?

We use the information we collect to provide you full access and functionality of the Website. Accordingly, your information may be used for the following purposes: (i) to provide and improve our Website, features and content; (ii) to administer your use of our Website and accounts; (iii) to enable users to enjoy and easily navigate the Website; (iv) to better understand your needs and interests; (v) to fulfill requests or to respond to questions or comments you may make; (vi) to personalize your experience; (vii) to provide you with announcements, notifications and advertisements related to your interests and use of the Website and other communications such as electronic newsletters, promotional e-mails or similar messaging; (viii) to provide service announcements; (ix) to protect against users seeking to hack into the Website; and (x) to assess the level of general interest in the Website.

SECTION 3 - DISCLOSURE

We may disclose non-personally identifiable aggregated information about our users without restriction.

We may disclose your personal information to our employees, vendors, service providers and affiliates as necessary to complete your transaction and provide you with access and functionality of the website.  We may share your personal information with marketing partners, network advertisers or ad exchanges to provide you information about products or services that may be of interest to you.

We may also disclose your personal information when required to do so by law, or when we believes in good faith that disclosure is reasonably necessary to protect the property or rights of OROS, third parties or the public at large.

We may also transfer our user information to a new entity in the event of a merger or acquisition. Any information transferred will remain subject to the privacy policy in effect at the time the information was collected.

We may also disclose your personally-identifying information if you expressly consent to the disclosure.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 5 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

 

SECTION 6- WEBSITE ACCESS INFORMATION AND COOKIES

Like most website operators, we collect non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request when visitors use the Website. Our purpose in collecting non-personally identifying information is to better understand how our visitors use the Services. From time to time, we may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its Services.  We also collect potentially personally-identifying information like Internet Protocol (IP) addresses and may collect statistics about the behavior of visitors to the Services. For instance, We may monitor the Website to help identify spam.  We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking).

 

In addition to log data, we may also collect information about the device you’re using to access the Services, including the type of device, the operating system, device settings, device identifiers and crash data. We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources or you provide to us.

Cookies and Web Beacons

Like many websites, the Website may use “cookies” to collect information.  A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. We may use cookies to help identify and track visitors, their usage of the Website, and their Website access preferences. Website visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Website, with the drawback that certain features of Website may not function properly without the aid of cookies. Certain features of our Website may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Website. Pages of our the Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages and for other related website statistics.

SECTION 7 – CHILDREN UNDER 18 MAY NOT USE THE WEBSITE

Children under 18 years of age are not permitted to use the Website for any purpose and OROS does not collect personally identifiable information about children under the age of 18.

SECTION 8 - CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

Tracking Technologies and Advertising.  You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

Promotional Offers from the Company.  If you do not wish to have your information used by the Company to promote our own or third parties’ products or services, you can opt-out by following the unsubscribe instructions provided on promotional emails. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.

SECTION 9 - ACCESSING AND CORRECTING YOUR INFORMATION  

You can review and change your personal information by if applicable, by logging into the Website and visiting your account profile page.

You may also send us an email at support@orosapparel.com to request access to, correct or delete any personal information that you have provided to us. We may not be able to delete your personal information without also deleting your user account.

We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

SECTION 10 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. We will post the updated policy on the Website and, if required by law, further notify you of the changes.  In all cases, use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected. Please check this policy frequently for updates and changes.  If you continue to use the Website after those changes are in effect, you agree to the revised policy.

SECTION 11- Your California Privacy Rights

You are permitted, and hereby agree, to only provide personal information to Oros if such personal information is accurate, reliable, and relevant to our relationship and only to the extent such disclosure will not violate any applicable data protection law, statute, or regulation.

You may have certain rights under applicable data protection law with respect to personal information about you that is collected through the Website or when you contact or otherwise engage with us. To exercise any of these data privacy rights, please contact us, or have your authorized agent contact us, in accordance with the “Questions and Contact Information” section listed below. In the event you submit, or your authorized agent submits on your behalf, a data request, you (and your authorized agent) hereby acknowledge and agree, under penalty of perjury, that you are (or the authorized agent of) the consumer whose personal information is the subject of the request. We will respond to any data requests within the timeframes required by law, and we may charge a fee to facilitate your request where permitted by law.

California Privacy Rights.  California Civil Code Section § 1798.83 permits users of the Sites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.  Pursuant to the California Consumer Privacy Act of 2018, as amended (“CCPA”), California residents may have certain data privacy rights, such as the right to be notified about what personal information categories are collected about you, and our intended use and purpose for collecting your personal information. You have the right to request access to your personal information and, to the extent feasible, request that it be transmitted in certain forms and formats.  You may have the right to request that we (and any applicable service provider) delete your personal information. You have the right not to be subject to discrimination for asserting your rights under the CCPA.  If you make, or an authorized agent on your behalf makes, any request related to your personal information, Oros will ascertain your identity to the degree of certainty required under the CCPA before addressing your request.  Oros may require you to match at least three pieces of personal information we have previously collected from you before granting you access or otherwise responding to your request. 

Do Not Track. Some web browsers may transmit “do-not-track” signals to the Sites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

European Union (EU) Privacy Disclaimer

Oros processes personal information in accordance with the legal bases set forth in the EU General Data Protection Regulation (GDPR) or EU Member State law. For example, our processing of Person Information on individuals (as described above) is justified based on statutory provisions that (1) processing is based on the consent; (2) processing is necessary for Oros’s legitimate interests as set out herein; and (3) processing is necessary for the performance of a contract to which you are a party. If you are in the EU or afforded protection under the GDPR, you may have certain rights with respect to the personal information. To the extent permitted by applicable data protection laws, you may access the personal information we hold about you; request that inaccurate, outdated, or no longer necessary information be corrected, erased, or restricted; and, request that we provide your personal information in a format that allows you to transfer it to another service provider. You also may withdraw your consent at any time where we are relying on your consent for the processing of your personal information. You may object to our processing of your personal information where that processing is based on our legitimate interest. You have the right to lodge a complaint with your competent data protection authority.
